By using the ExamEval service, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use the service.

2. Use of Service

ExamEval provides AI-powered tools to help educators improve their exam content. The service is offered "as is" and may be updated, modified, or discontinued at our discretion without notice.

3. User Accounts & Communication

• Accounts are required to access certain features. You are responsible for maintaining the confidentiality of your credentials. You may not share your login credentials or allow others to access your account.
• You agree to provide accurate information and be at least 18 years old or have guardian consent.
• By registering, you may receive service updates and optional marketing messages (opt-out available).

4. Prohibited Uses

You agree not to misuse the service, including but not limited to violating laws, interfering with system functionality, submitting malicious code, infringing intellectual property rights, or using the service in a way that compromises academic integrity or institutional policies.

5. Intellectual Property

All content and intellectual property related to ExamEval are owned by ClinCalc LLC. Reproduction or distribution without permission is prohibited.

6. Disclaimer and Limitation of Liability

The service is provided "as is." ClinCalc LLC is not liable for indirect or consequential damages resulting from the use of the service. AI-generated results may include inaccuracies and should be independently reviewed. Users are responsible for critically reviewing any output.

7. Indemnification

You agree to indemnify ClinCalc LLC for any claims or liabilities arising from your use of the service or violation of these terms.

8. Termination

We reserve the right to suspend or terminate your access to the service at any time, without notice, for any violation of these terms or other reasons at our sole discretion. You may stop using the service at any time.

9. Content Ownership and Usage Rights

You retain ownership of any exam content you submit. By submitting content, you grant ClinCalc LLC a non-exclusive, royalty-free license to store, process, and analyze your content for the sole purpose of providing services to you. We do not claim ownership of your content and will not share it with third parties, except as required to deliver the service.

Submitted exam content will be retained for a maximum of 30 days, but users may delete the exam content earlier if desired. Users may delete their account at any time using the service, which will result in the permanent deletion of all associated data.

10. Payments, Subscriptions & Refunds

If you purchase services, you agree to provide current, complete, and accurate billing information. Subscriptions may auto-renew unless canceled. We reserve the right to adjust pricing and will notify users of changes in advance.

Refunds for direct purchases through ExamEval.com may be requested within 7 days of purchase. Refunds for app store transactions are subject to the store’s policies and must be requested directly from the respective store.

11. Feedback

Feedback you provide may be used to enhance the service without compensation or obligation.

12. External Links

We are not responsible for content or privacy policies of third-party websites linked from our service.

14. Governing Law

These terms are governed by the laws of Illinois. Disputes will be resolved in courts located within Illinois.

15. Severability

If any provision is held invalid, the remaining provisions will remain in full force.

16. Changes to Terms

We reserve the right to change these terms at any time. Updates will take effect immediately upon posting. Continued use of the service after changes are made constitutes your acceptance of the new terms.
